Worker Killed At Construction Site in Southwest Harris County, TX

Harris County, TX – ABC13 reports a worker was killed at a construction site in Southwest Harris County, TX.

Sherriff Ed Gonzalez reported a worker operating heavy equipment struck and killed the man.

The accident happened at approximately 5 p.m. on March 3, 2021 at 14800 Almeda Road near West Riley.

An investigation is continuing to determine the cause of the accident.

Pursuing An-On-The-Job Injury Or Death Claim

Workers' Compensation is insurance regulated by the state to ensure workers receive medical care and some wages after an on-the-job injury.  By subscribing to the Texas Workers' Compensation system, the employer is given immunity from being sued by the injured employee in a civil court. The idea behind this system is to ensure the injured worker receives medical treatment and some lost wages without having to prove the employer was a fault. It supposedly protects the injured worker. Often, however, the benefits paid to an injured worker may be insufficient to compensate him or her for the full damages and losses as a result of the accident.

Even if the employer subscribes to workers' compensation, the employer is not completely protected from civil liability. The family of the deceased can pursue a lawsuit against the subscribing employer if it can be shown the gross negligence of the employer caused or contributed to the death of the worker. To prove gross negligence, the family must show:

  • What the employer did or failed to do created an extreme degree of risk;
  • The employer had actual subjective awareness of the extreme degree of risk of what they did or failed to do; and
  • Even with that subjective awareness, the employer still did something or failed to do something with “conscience indifference” to the safety of the worker.
