Can A Passenger Receive Compensation For Injuries After A Car Accident?
While operating a motor vehicle, drivers have a legal responsibility to act reasonably so as not to harm or injure other motorists by their driving behavior. This legal responsibility extends to passengers.
Passengers have the right to seek legal compensation against anyone who caused their injuries. Common reasons a passenger may pursue a legal claim against the driver includes:
- Distracted driving (texting, reaching over to pick up something)
- Speeding
- Driving recklessly
- Driving under the influence
- Street racing
Typically, the driver's automobile insurance would be responsible for paying for a passenger's injuries, but it must be proven the driver's actions caused the injuries and losses. An immediate investigation is needed to uncover the complete facts. In some instances, a driver may not have insurance or has insufficient insurance. In that event, further investigation is needed to identify other financial recovery sources.
