On July 25, 2020, Justice David L. Bridges, a justice on the Texas 5th Court of Appeals was killed by a suspected intoxicated driver in a wrong-way crash. According to the preliminary investigation, an intoxicated driving was driving the wrong way about 9:30 p.m. in the westbound lanes of I-30 near FM 2642 and struck two vehicles. Justice Bridges was killed and the driver of the second vehicle was reportedly uninjured.
The drunk driver faces a charge of intoxication manslaughter.
Who's Responsible in a Drunk Driving Accident?
In drunk driving cases, the primary defendant is the drunk driver. In most cases, the criminal case against the intoxicated driver will be brought first. Experienced Houston TX Drunk Driving Accident Lawyers will work with the authorities to use the evidence collected to hold the drunk driver criminally and civilly liable for the injuries they caused to others.
If you're lucky, the drunk driver will have enough insurance to pay for your medical bills, lost income, and property damage. If they don't have any liability insurance or don't have enough to pay your full claim, you can generally file a Uninsured/Under-Insured (UM/UIM) claim with your own insurance company. If you have collision insurance, you should file a claim with your collision carrier.
If the car involved in the accident was owned by someone other than the drunk driver, then the owner of the car may also be liable if they gave the drunk driver permission to use their vehicle.
If the drunk driver was drinking at a bar before the accident, you also may be able to sue the business or other third party that provided the alcohol to the drunk driver. In Texas, this is known as a “dram shop” claim.
An experienced Houston TX Drunk Driving Accident Lawyer can investigate the circumstances of the accident, help you with the insurance claims process and pursue all responsible parties.
